1. כללי
ברוכים הבאים לאתר של סהר מלול לבניית אתרים. תנאי שימוש אלה מסדירים את השימוש באתר ובשירותים המוצעים בו. המשך גלישה באתר ו/או שימוש בשירותים מהווה הסכמה מצדך לתנאים אלו.
2. שירותים
סהר מלול מציעה שירותי בניית אתרים הכוללים:
- תכנון ועיצוב אתרים מקצועיים
- פיתוח אתרים רספונסיביים
- בניית דפי נחיתה
- פיתוח אתרי מסחר אלקטרוני
- תחזוקה ותמיכה שוטפת
- שירותי אחסון ודומיין
3. הזמנת שירותים
ההתקשרות לקבלת שירותים תיעשה באמצעות:
- טופס יצירת קשר באתר
- פנייה בטלפון או WhatsApp
- התכתבות באימייל
לאחר קבלת הפנייה, יישלח הצעת מחיר מפורטת הכוללת את היקף הפרויקט, לוחות זמנים ועלויות.
4. תשלום
תנאי התשלום יפורטו בהצעת המחיר ויכללו:
- מקדמה של 50% מהסכום הכולל לפני תחילת העבודה
- יתרת 50% עם השלמת הפרויקט ולפני העלאה לאוויר
- אפשרות לתשלומים עבור פרויקטים גדולים - בתיאום מראש
- כל התשלומים כוללים מע"ם
5. זכויות יוצרים וקניין רוחני
5.1 בעלות על העבודה
לאחר קבלת התשלום המלא, הלקוח יקבל את מלוא הזכויות על התוכן המקורי שנוצר עבורו, לרבות העיצוב והקוד המותאם אישית.
5.2 רישיונות צד שלישי
כל פלאגין, תוסף או קוד של צד שלישי שמשולב בפרויקט כפוף לרישיון המקורי שלו.
5.3 תיק עבודות
סהר מלול שומרת לעצמה את הזכות להציג את הפרויקטים שביצעה בתיק העבודות שלה, אלא אם הוסכם אחרת במפורש.
6. אחריות ותחזוקה
6.1 אחריות על העבודה
כל פרויקט כולל תקופת אחריות של 30 יום ממועד העלאת האתר לאוויר, הכוללת תיקון באגים וליקויים טכניים שנוצרו עקב העבודה המקורית.
6.2 מה לא כלול באחריות
- בעיות הנובעות משינויים שבוצעו על ידי הלקוח או צד שלישי
- תקלות הנובעות מעדכוני מערכת או פלאגינים חיצוניים
- בעיות הנובעות מספק האחסון או דומיין
- תוכן חדש או שינויים בעיצוב - ייחשבו כעבודה חדשה
7. ביטול והחזרים
ניתן לבטל פרויקט בכל שלב על פי התנאים הבאים:
- ביטול לפני תחילת העבודה - החזר מלא של המקדמה בניכוי 10% דמי ביטול
- ביטול לאחר תחילת העבודה - תשלום יחסי בהתאם לשעות העבודה שהושקעו
- ביטול לאחר השלמת 75% מהפרויקט - אין זכאות להחזר כספי
8. מגבלות אחריות
האתר והשירותים ניתנים "כמות שהם" ו"כפי שהם זמינים". סהר מלול אינה אחראית:
- לנזקים עקיפים, תוצאתיים או מיוחדים
- לאובדן רווחים, נתונים או מוניטין
- לתקלות בספקי אחסון או שירותי צד שלישי
- לתוכן שמועלה על ידי הלקוח
9. פרטיות והגנת מידע
השימוש במידע אישי שנמסר על ידי הלקוחות מוסדר במדיניות הפרטיות של האתר. המידע משמש אך ורק למטרת מתן השירות ולא יועבר לצדדים שלישיים ללא הסכמה מפורשת.
10. שינויים בתנאי שימוש
סהר מלול שומרת לעצמה את הזכות לשנות את תנאי השימוש מעת לעת. שינויים משמעותיים יפורסמו באתר והלקוחות הפעילים יקבלו הודעה במייל.
11. סמכות שיפוט
על תנאי שימוש אלו יחולו אך ורק דיני מדינת ישראל. סמכות השיפוט הבלעדית נתונה לבתי המשפט במחוז תל אביב-יפו.

3. Service Ordering
Service engagement will be made through:

- Email correspondence
After receiving your inquiry, a detailed quote will be sent including project scope, timelines, and costs.
4. Payment
Payment terms will be detailed in the quote and include:
- 50% deposit of the total amount before starting work
- Remaining 50% upon project completion and before going live
- Payment plans available for large projects - by prior arrangement
- All payments include VAT
5. Copyright and Intellectual Property
5.1 Ownership of Work
Upon receipt of full payment, the client will receive full rights to the original content created for them, including the design and custom code.
5.2 Third-Party Licenses
Any third-party plugin, add-on, or code integrated into the project is subject to its original license.
5.3 Portfolio
Sahar Malul reserves the right to showcase completed projects in her portfolio, unless otherwise explicitly agreed.
6. Warranty and Maintenance
6.1 Work Warranty
Each project includes a 30-day warranty period from the website launch date, covering bug fixes and technical issues arising from the original work.
6.2 What's Not Included in Warranty
- Issues resulting from changes made by the client or third parties
- Problems arising from system or external plugin updates
- Issues arising from hosting provider or domain
- New content or design changes - considered new work
7. Cancellation and Refunds
A project can be cancelled at any stage according to the following terms:
- Cancellation before work begins - full deposit refund minus 10% cancellation fee
- Cancellation after work begins - proportional payment based on hours invested
- Cancellation after 75% project completion - no refund eligibility
8. Limitation of Liability
The website and services are provided "as is" and "as available". Sahar Malul is not responsible for:
- Indirect, consequential, or special damages
- Loss of profits, data, or reputation
- Hosting provider or third-party service failures
- Content uploaded by the client
9. Privacy and Data Protection
The use of personal information provided by clients is governed by the website's Privacy Policy. Information is used solely for service provision and will not be transferred to third parties without explicit consent.
10. Changes to Terms of Service
Sahar Malul reserves the right to modify these Terms of Service from time to time. Significant changes will be posted on the website and active clients will be notified by email.
11. Jurisdiction
These Terms of Service shall be governed solely by the laws of the State of Israel. Exclusive jurisdiction is granted to the courts in the Tel Aviv-Jaffa district.
